DMCA & Copyright Policy
How to report alleged copyright infringement to us.
1. Our position
Lekito Marketing respects the intellectual property rights of others and expects users of this website to do the same. We respond to clear notices of alleged copyright infringement that comply with the requirements set out below, in a manner consistent with the United States Digital Millennium Copyright Act (DMCA) and with applicable Costa Rican law.
2. Submitting a notice of infringement
If you believe that material available on this website infringes a copyright you own or are authorised to act on behalf of, please send a written notice to info@lekitomarketing.com with the subject line “Copyright Notice”, or by post to the address at the foot of this page.
To be effective, your notice must include all of the following:
- A physical or electronic signature of the copyright owner, or of a person authorised to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of those works.
- Identification of the material claimed to be infringing, with information reasonably sufficient to let us locate it — a direct URL is the most useful form.
- Your name, postal address, telephone number and email address.
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on their behalf.
3. What happens next
On receipt of a valid notice we will review it and, where the claim appears well founded, remove or disable access to the material concerned. Where we can identify the party responsible for the material, we will notify them and provide a copy of the notice.
4. Counter-notification
If you believe material of yours was removed or disabled as a result of mistake or misidentification, you may send a counter-notification to info@lekitomarketing.com containing:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location at which it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, postal address and telephone number, and a statement that you consent to the jurisdiction of the courts described in the applicable law and will accept service of process from the party who submitted the original notice.
We may restore the removed material if we do not receive notice that the original complainant has filed an action seeking a court order, within the period provided by applicable law.
5. Misrepresentation and repeat infringers
Under the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages. We reserve the right to terminate access for users who are determined to be repeat infringers, and to take any other action we consider appropriate.
